However, individuals who have been acting for more than six months have received a significant respite after MPs rejected a Bill denying them allowances, labeling such a proposal as unfair labor practices and discrimination.

The National Assembly Labour Committee rejected the plan, stating that it would be against the Constitution and the Employment Act in a report on the Public Service Commission (Amendment) Bill 2023.

According to the assessment, “This provision’s implementation would lead to unfair labor practices in violation of article 27 of the Constitution on the freedom from discrimination and right to fair labor practices.”
The committee emphasized that an employer must provide equal pay for equal effort under Section 5 of the Employment Act of 2007.
Anyone who works past that time will not be eligible for an acting allowance.
The Bill, sponsored by Embakasi Central MP Benjamin, aims to amend Section 34 of the Act to provide for the non-payment of acting allowance after six months,
Claiming that the time an official is in acting capacity is sufficient for any organization to recruit a suitable applicant for the position.
“The six-month period prescribed should allow the organization enough time to recruit and substantively fill the position.” Failure to comply with this provision will result in the officer not receiving acting allowances,” the Bill states.
